Police say Diller, 31, and his partner Monday afternoon during a traffic stop on illegally parked cars in Far Rockaway, Queens. when someone in the car pulled out a gun and pointed it at the officer. Police said there was a gunfight and Diller was shot in the torso under his bulletproof vest.
Diller was rushed to a local hospital, where he later died.
Police say Diller has been with the NYPD for three years. worked with the department's regional response team in Queens.. He grew up in Franklin Square; Lived in Massapequa Park With my wife Stephanie and 1 year old son Ryan.

The suspect was identified as 34-year-old Guy Rivera; He is charged with first-degree murder, attempted murder and possession of a weapon against a police officer.. He was also injured in the shooting and remains in the hospital.
Lindy Jones, the alleged driver of the car, He is charged with possession of a loaded firearm and possession of a defaced weapon.. CBS New York has learned that at the time of the traffic stop, Jones was being held on $75,000 bond for past weapons offenses.
