Elena Moreno, 47, is charged with theft between $30,000 and $150,000, a second-degree felony.

past legal troubles
Moreno was previously arrested on March 16 after his family told police they had written a check for $8,508.09 for the headstone but never received it.
The arrest affidavit states Moreno gave the family nine to 12 months due to the coronavirus.
SAPD said the family attempted to contact Moreno from October 12, 2023 to February 12, 2024, but Moreno rarely responded.
Later, they received notice from First Memorial Park Funeral Home that other families who had purchased headstones from Moreno were also having trouble obtaining their headstones.
KSAT attempted to contact Moreno via email, social media messages, and visits to her listed business and home addresses, but she did not respond.
Moreno was formally charged with theft between $2,500 and $30,000, which is considered a state prison felony.
A total of 12 people contacted KSAT and said they gave Moreno money for gravestones they never received.
Through paperwork, KSAT confirmed that the families who came forward spent a total of $40,000 on the headstones.
KSAT will update you with the latest details as they become available.
